Activists score a victory in Senate against ‘Monsanto Protection Act’

Called “The Monsanto Protection Act” by opponents, the budget rider shields biotech behemoths like Monsanto, Cargill and others from the threat of lawsuits and bars federal courts from intervening to force an end to the sale of a GMO (genetically-modified organism) even if the genetically-engineered product causes damaging health effects.

The US House of Representatives approved a three-month extension to the rider in their own short-term FY14 Continuing Resolution spending bill, which was approved last week by the lower chamber.

The Senate version of the legislation will make clear the provision expires on Sept. 30, the end of the current fiscal year.

“That provision will be gone,” Sen. Mark Pryor (D-Ark.) told Politico.

Pryor chairs the Senate subcommittee on agriculture appropriations.

The Center for Food Safety said the Senate’s eradication of the rider was “a major victory for the food movement” and a “sea change in a political climate that all too often allows corporate earmarks to slide through must-pass legislation.”

“Short-term appropriations bills are not an excuse for Congress to grandfather in bad policy,” said Colin O’Neil, the Center for Food Safety’s director of government affairs.

The biotech rider first made news in March when it was a last-minute addition to the successfully-passed House Agriculture Appropriations Bill for 2013, a short-term funding bill that was approved to avoid a federal government shutdown.

Following the original vote in March, President Barack Obama signed the provision into law as part of larger legislation to avoid a government shutdown. Rallies took place worldwide in May protesting the clandestine effort to protect the powerful companies from judicial scrutiny.

Largely as a result of prior lawsuits, the US Department of Agriculture (USDA) is required to complete environmental impact statements (EIS) to assess risk prior to both the planting and sale of GMO crops. The extent and effectiveness to which the USDA exercises this rule is in itself a source of serious dispute.

The reviews have been the focus of heated debate between food safety advocacy groups and the biotech industry in the past. In December of 2009, for example, Food Democracy Now collected signatures during the EIS commenting period in a bid to prevent the approval of Monsanto’s GMO alfalfa, which many feared would contaminate organic feed used by dairy farmers; it was approved regardless.

The biotech rider “could override any court-mandated caution and could instead allow continued planting.  Further, it forces USDA to approve permits for such continued planting immediately, putting industry completely in charge by allowing for a ‘back door approval’ mechanism,” the Center for Food Safety said earlier this month upon news the House was reviving the measure.

With 45 votes in favor, members of the FMLN, Unidos por El salvador and GANA approved the amendment of a Law on the control of pesticides, fertilizers and products for agricultural use, which allows the prohibition of 53 chemicals in El Salvador.

Among the list of the 53 chemicals are Paraquat, Glyphosate and Endosulfan, which caused controversy among right-wing deputies. Deputy Mario Ponce, of the Alianza Republicana Nacionalista (ARENA) party, opposed these substances being on the list, however, he did not have the support of other MPs.

Nery Diaz, deputy of the Frente Farabundo Martí party (FMLN) defended the opinion on the grounds that paraquat is related to an increase in renal diseases.

According to the president of the Association of Coffee Producers (ABECAFE), Carlos Borgonovo, the congressional initiative threatens the quality and quantity of the grain harvest. “At the moment there is no substitute, we would have to order in from an international laboratory,” said Borgonovo referring to the chemical endosulfan. This product is used for controlling the coffee berry borer pest.

In relation to herbicides, both Borgonovo as well as Marcelino Samayoa, director of ABECAFE agree that you cannot depend on labor dedicated to removing weeds. While these chemicals are applied twice a year, removing weeds with a machete requires twice as much effort.

For its part, the National Executive Council (COENA) asked President Mauricio Funes to study the decree banning the use of these 53 pesticides and fertilizers because they are working against the country’s agricultural sector.

“The call is for there to be a lot of research carried out and that prior to sanctioning, vetoing or monitoring them, there be observations of the impact that it will have in the medium and long term, not only in relation to the issue of food security, but also in relation to economics” said Ricardo Esmahán, COENA member.

It's a sure sign that you've jumped into a circle of dogma when the very act of asking intelligent questions is no longer allowed. Any speakers who might ask questions about genetically engineered foods are strictly forbidden by TED. This makes TED a source of pseudoscience because it censors and silences any dissenting views that don't align with Monsanto and the Frankenfoods biotech industry.

The TEDx letter actually claims that anyone who questions the wisdom of genetically engineering food crops grown in open fields is a quack or a hoaxer.

Read the letter yourself. It reads as if it were written by someone with the intellectual capacity of an 8th grader -- someone who is so naive that they still haven't caught on to the fact that corporations routinely lie to the world by hijacking science to push their agenda of profit and domination. And it makes you wonder just how stupid TED thinks the public really is on the subject of GMOs. Even though 90% of the public believes GMOs should be labeled on foods, TED thinks anyone who dares talk about GMOs is spewing "pseudoscience."

Does TED also think that spraying the world with glyphosate is a boon to mankind? Does TED even know what glyphosate is and how glyphosate causes cancer at concentrations of parts per billion?

In April 2013, Peru placed a 10-year moratorium on GMO foods and plants. This prohibits the import, production and use of GMOs in foods and GMO plants and is aimed at safeguarding Peru’s agricultural diversity. The hope is to prevent cross-pollination with non-GMO crops and to ban GMO crops like Bt corn. What will become of Peru’s moratorium if the TPP is passed?

The TPP will also implement new levels of internet tyranny, outlawing the “Fair Use” of material and turn your ISP into a government enforcement arm as they will face heavy fines for allowing anything that violates the TPP.

California Sues Whole Foods Over All-Natural Pesticides, Ignores Cancer Causing Pesticides

The state of California has taken up the noble task of suing natural food retailer Whole Foods over all-natural pesticides the California Department of Pesticide Regulation says it has not approved of. The natural pesticides, including: 365 Natural Pines Pellet Cat Litter, Purely Botanical Cat Flea Spray, Purely Botanical Dog Flea Spray and Enviroman Bugs R Done Bug spray are being sold at Whole Foods markets despite the government reportedly not authorizing permission to sell these products in California.

Perhaps these products would have been readily approved had the companies greased the pockets of California politicians like Monsanto and other large corporations do when legally bribing or 'lobbying' government officials to pass laws that favor their companies and speed up the regulatory approval process. 



One may naturally question the credibility of the California Department of Pesticide Regulation after it willingly disobeyed constituents when it approved the use of methyl iodide pesticides in December 2011, despite even the farmers' unwillingness to use the chemical.

The controversy over methyl iodide has simmered for years, but it erupted in 2010 when Department of Pesticide Regulation managers overruled both their own staff scientists and an agency-appointed peer review panel to approve the chemical for use in California agriculture. 
UCLA professor John Froines, who led the peer review committee, appeared at a state Assembly hearing in Sacramento last April and said “science was subverted” in the state’s decision to approve methyl iodide. 
“I would not want my family, my friends or anyone else to live or work or go to school near fields where this methyl iodide will be used,” Froines said after detailing the chemical’s properties that are known to cause cancer and damage nervous systems. “You had the best science you could have had, and the fact that it was ignored is devastating.”
It seems that despite popular opposition, farmer's reluctance to adopt the chemical pesticide, and clear science showing that this chemical would cause drastic negative health and environmental effects, it was still approved by California Department of Pesticide Regulation: making claims of bribery all the more likely.

The pesticide has since been abandoned in the US by the manufacturer Arysta LifeScience Inc. due to questions over the safety and effectiveness of the product and lack of interest from farmers who were afraid to use it due to consumer and political backlash.

As the war on natural health continues to march on, many people are beginning to question the objectivity and even legitimacy of regulatory bureaucracies who often times receive a large portion of their budgets directly from Big Pharma and Big Food. In fact, the FDA's year over year budget increase of nearly 1 billion dollars is 94% funded by Big Pharma, yet the agencies escape any transparency due to the mainstream media's willful ignorance(and perhaps the $2.4 billion the media receives in ad revenue from Big Pharma every year).

Recent Study Proves Organic Food Healthier than GMO and 'Conventional' Foods

TORONTO, Canada (IPS/GIN) - Organic foods protect children from the toxins in pesticides, while foods grown using modern, intensive agricultural techniques contain fewer nutrients and minerals than they did 60 years ago, according to two new scientific studies.

A U.S. research team from Emory University in Atlanta analyzed urine samples from children ages three to 11 who ate only organic foods, and found that they contained virtually no metabolites of two common pesticides, malathion and chlorpyrifos.

However, once the children returned to eating conventionally grown foods, concentrations of these pesticide metabolites quickly climbed as high as 263 parts per billion, says the study, which was published Feb. 21.

Organic crops are grown without the chemical pesticides and fertilizers that are common in intensive agriculture.

There was a dramatic and immediate protective effect" against the pesticides while consuming organically grown foods, said Chensheng Lu, an assistant professor at the Rollins School of Public Health at Emory University.

These findings, along with the results of another study published in Britain earlier in March, have fueled the debate about the benefits of organically grown food versus conventional, mass-produced foods. According to the new British analysis of government nutrition data on meat and dairy products from the 1930s and 2002, the mineral content of milk, cheese and beef declined as much as 70 percent in that period.

"These declines are alarming," Ian Tokelove, spokesman for The Food Commission that published the results of the study, told Tierramerica. The commission is a British non-governmental organization advocating healthier, safer food.

The research found that parmesan cheese had 70 percent less magnesium and calcium; beef steaks contained 55 percent less iron; chicken had 31 percent less calcium; and 69 percent less iron, while milk also showed a large drop in iron, along with a 21 percent decline in magnesium. Copper, an important trace mineral (an essential nutrient that is consumed in tiny quantities), also declined 60 percent in meats and 90 percent in dairy products.

Although controversial, a number of other studies have also found differences between conventionally produced foods and foods grown organically or under more natural conditions. Organic fruits and vegetables had significantly higher levels of cancer-fighting antioxidants, according to a 2003 study in the Journal of Agricultural and Food Chemistry. The organic plants produced these chemical compounds to help fight insects and competing plants, researchers said.

A 2001 report by Britain's Soil Association looked at 400 nutritional research studies and came to similar conclusions: Foods grown organically had more minerals and vitamins.

"Modern plant breeding for quick growth and high yields could also be affecting the nutritional quality," says Katherine Tucker, director of the nutritional epidemiology program at Tufts University in Boston.

Farmers in other parts of the world should not adopt the intensive farming practices of North America or Europe, says Ken Warren, a spokesman with The Land Institute, which is based in Kansas.

"It's an unsustainable system that relies heavily on chemical fertilizers ... to keep yields high and produces hollow food," he told Tierramerica.

"Hollow food" contains insufficient nutrition and is suspected in playing a role in the rapid rise in obesity, as people may be eating more to get the nutrition they need, he explained.

Crops take minerals, trace elements and other things from the soil every year. Modern agriculture only puts back into the land some chemical fertilizers, which do not replace all that has been lost, Mr. Warren noted.

Moreover, herbicides and insecticides kill microorganisms in the soil that play an important role in maintaining soil fertility and helping plants grow.

Pesticide residues in modern agriculture are another cause for concern. A 2003 University of Washington study found that children eating organic fruits and vegetables had concentrations of pesticide six times less than children eating conventional produce.

The Land Institute advocates what it calls natural systems agriculture." This involves the use of perennial crops in polycultures: planting several different crops together as has been practiced in traditional gardens and farm plots in many parts of the world.

"Farmers in other parts of the world should learn from American agriculture's mistakes," Mr. Warren maintained. Looking to nature is a better model for farming."

Bayer has just sued the European Commission to overturn a ban on the pesticides that are killing millions of bees around the world. A huge public push won this landmark ban only months ago -- and we can't sit back and let Big Pesticide overturn it while the bees vanish.

American Farmers Appeal to U.S. Supreme Court to Seek Protection from Genetic Contamination and Invalidate Monsanto's Patents on Genetically Engineered Crops

New York - September 5, 2013 - A group of 73 American organic and conventional family farmers, seed businesses and public advocacy groups asked the U.S. Supreme Court today to hear their case against Monsanto Company challenging the chemical and biotech seed giant's patents on genetically engineered seed. In Organic Seed Growers and Trade Association (OSGATA) et al v. Monsanto, the plaintiffs have been forced to sue preemptively to protect themselves from being accused of patent infringement should their fields ever become contaminated by Monsanto's genetically engineered seed, something Monsanto has done to others in the past.

In a June 10th ruling earlier this year, a three-judge panel at the Court of Appeals for the Federal Circuit ruled that a group of organic and otherwise non-GMO farmer and seed company plaintiffs are not entitled to bring a lawsuit to protect themselves from Monsanto's transgenic seed patents "because Monsanto has made binding assurances that it will not 'take legal action against growers whose crops might inadvertently contain traces of Monsanto biotech genes (because, for example, some transgenic seed or pollen blew onto the grower's land).'"

"While the Court of Appeals correctly found that the farmers and seed sellers had standing to challenge Monsanto's invalid patents, it incorrectly found that statements made by Monsanto's lawyers during the lawsuit mooted the case," said Daniel Ravicher, Executive Director of the Public Patent Foundation (PUBPAT) and lead counsel to the plaintiffs in OSGATA et al v. Monsanto. "As a result, we have asked the Supreme Court to take the case and reinstate the right of the plaintiffs to seek full protection from Monsanto's invalid transgenic seed patents."

The plaintiffs brought the pre-emptive case against Monsanto in March 2011 and specifically seek to defend themselves from nearly two dozen of Monsanto's most aggressively asserted patents on GMO seed. They were forced to act pre-emptively to protect themselves from Monsanto's abusive lawsuits, fearing that if GMO seed contaminates their property despite their efforts to prevent such contamination, Monsanto will sue them for patent infringement.

"We have been farming for almost forty years and we have never wanted anything to do with Monsanto," said Jim Gerritsen, an organic seed farmer in Maine and President of lead PlaintiffOSGATA.  "We believe we have the right to farm and grow good food the way we choose.  We don't think it's fair that Monsanto can trespass onto our farm, cjim gerritsenontaminate and ruin our crops and then sue us for infringing on their patent rights.  We don't want one penny from Monsanto. American farmers deserve their day in Court so we can prove to the world Monsanto's genetically engineered patents are invalid and that farmers deserve protection from Monsanto's abuse."

In the case, the plaintiffs are asking the courts to declare that if organic farmers are ever contaminated by Monsanto's genetically engineered seed, they need not fear also being accused of patent infringement. One reason justifying this result is that Monsanto's patents on genetically engineered seed are invalid because they don't meet the "usefulness" requirement of patent law, according to Ravicher. Evidence cited in the plaintiffs' court filings proves that genetically engineered seed has negative economic and health effects, while the promised benefits of genetically engineered seed - increased production and decreased herbicide use - are false.

As Supreme Court Justice Joseph Story wrote in 1817, to be patentable, an invention must not be "injurious to the well-being, good policy, or sound morals of society," and "a new invention to poison people ... is not a patentable invention."  Because transgenic seed, and in particular Monsanto's transgenic seed, is "injurious to the well-being, good policy, or sound morals of society" and threatens to "poison people," Monsanto's transgenic seed patents are all invalid.

With the rapid adoption of Monsanto's genetically engineered seed technology, America's farmers have been faced with a rampant rise in superweeds, with more than 49% of U.S. farmers reporting glyphosate-resistant weeds on their farm in 2012, up from 34% that farmers reported in 2011. In addition, scientists are reporting the growing failures of Monsanto's genetically engineered insecticide-corn, with reports from scientists in the Midwestern corn belt states detailing the rise of super insects becoming resistant to the genetically engineered Bt toxin, leaving farmers vulnerable to the voracious corn rootworm, the number one threat to corn farmers.

"For the past twenty years, Monsanto has used its political and financial power to foist a deeply flawed technology on America's farmers, consistently underestimating the real risks of genetic engineering while putting America's farmers, the environment and the public in harm's way simply in the name of profit," said Dave Murphy, founder and executive director of Food Democracy Now!, a grassroots movement of more than 650,000 farmers and citizens. "As the leading arbiters of justice in the U.S., it behooves the Supreme Court to hear this important case to protect America's farmers from abusive patent infringement lawsuits and invalidate Monsanto's flawed patents as their products have been shown to be damaging to human health and the environment and failed to live up to the marketing hype."

A study published June 14th 2013, in the Journal of Applied Ecology sheds some much needed light on the severe implications of neonicotinoid insecticides. Neonicotinoid insecticides are applied to the seeds of target crops and grow with the plant which make them systemic within these crops, travelling through all the tissues of the plant. This makes them highly effective at killing insects, which in turn makes them the most widely used pesticides in the world.

The use of neonicotinoids is entirely contradictory to the sustainable farming method of integrated pest management (IPM). Also when comparing the cost of application to the benefit provided, the cost of the insecticide is often found to exceed that of actual crop yield. The author of the study, Prof Dave Goulson, says: “Studies from the US suggest that neonicotinoid seed dressings may be either entirely ineffective or cost more than the benefit in crop yield gained from their use. We seem to be in a situation where farmers are advised primarily by agronomists involved in selling them pesticides.”

New findings show that neonicotinoids persist and accumulate in the soil longer than originally findings have shown. Being systemic they are also in the pollen and nectar of treated plants, which provides for their unintended spreading and harm as the concentrations are sufficient to substantially impact colony reproduction in bumblebees. Only 20% of the applied chemical remains with the seed, the other 80% is lost during sowing in the air and soil. The aerial dust alone, that results from sowing seeds, has shown to cause
direct mortality in nearby flying honeybees.

The impact of pesticides on honeybees has taken such a toll that even the mainstream media is now forced to cover it.

As a huge ballot initiative heats up in Washington state to label GMO food products, corporate powers are shoveling money into propaganda campaigns and the pockets of influential people.  But it may not be enough this time.  Awareness is expanding exponentially about the threats GMOs pose to our food system, public health, and the environment.

The Organic Consumers Association built a grassroots database, based on input from consumers and extensive interviews, of grocers committed to selling non-GMO products.  Support these grocers if you live in the area.  They are leaders on the front line.

Hedge funds dumping Monsanto stock as reality of GMOs sinks in

CEO Hugh Grant just sold off 40,000 shares at $97.74, and both Janet Holloway and Gerald Steiner — both high-level Monsanto executives — recently ditched more than 10,000 shares each. Tom Hartley also bailed on another 6,000 shares at $100.15. (See sources below.)
Hedge funds, meanwhile, are also dumping Monsanto stock, most likely due to sharply increased “negative sentiment.” This means people increasingly don’t like Monsanto, and that’s a direct result of all the growing realizations about the dangers of GMOs, Monsanto’s predatory business practices, the company’s dangerous experiments that have already unleashed genetic pollution, and the fact that GM corn has been experimentally found to cause widespread cancer tumors in rat studies.
Just the fact that Monsanto’s GE wheat trials got out of control and contaminated a wheat field in Oregon — causing Japan and South Korea to ban U.S. wheat imports — has resulted in 150 groups now demanding the USDA keep a tighter lid on Monsanto’s GMO experiments. These groups are fed up with seeing the market value of their crops destroyed by sloppy “open field” experiments being conducted by Monsanto that spread genetic pollution across the country and contaminate non-GMO crops. (Monsanto goes even further and actually sues the farmers whose fields they contaminated!)

Hedge funds dumping Monsanto

As InsiderMonkey.com reports, Monsanto “has experienced declining interest from the entirety of the hedge funds we track.”
The report goes on to say:
At the top of the heap, Jeffrey Vinik’s Vinik Asset Management said goodbye to the largest stake of the 450+ funds we monitor, totaling close to $100.8 million in [Monsanto] stock. Sean Cullinan’s fund, Point State Capital, also dropped its [Monsanto] stock, about $54.7 million worth.
These sales leave Stephen Mandel’s Lone Pine Capital with the largest holdings of Monsanto, over $613 million worth of the company’s stock. Natural News urges all investors to ditch Lone Pine Capital and take your money somewhere else that doesn’t invest in “the world’s most evil corporation.”
Blue Ridge Capital also owns over $320 million in Monsanto stock and should be immediately abandoned by all investors.
Monsanto share prices plummeting ever since the March Against Monsanto
So far this year, Monsanto (MON) share prices have plummeted from a high of $109 to a current trading range around $95. That’s a drop of nearly 13%, and the bad news for Monsanto just keeps coming.
For one, the European Union’s new food safety guidelines affirm the methodology and findings of the Seralini GM corn rat study. As much as the biotech industry and all its pimped-out science trolls have attempted to attack the study, the secret is already out: GM corn causes cancer tumors and consumers accurately see GM corn as equivalent to a “poison” symbol on foods.
The Seralini study, by the way, found that:
• Up to 50% of males and 70% of females suffered premature death.
• Rats that drank trace amounts of Roundup (at levels legally allowed in the water supply) had a 200% to 300% increase in large tumors.
• Rats fed GM corn and traces of Roundup suffered severe organ damage including liver damage and kidney damage.
• The study fed these rats NK603, the Monsanto variety of GM corn that’s grown across North America and widely fed to animals and humans. This is the same corn that’s in your corn-based breakfast cereal, corn tortillas and corn snack chips.

The future for sales of Monsanto’s GM corn look especially bleak due to the simple fact that GMO labeling is now inevitable. The consumer push to know what’s in our food is unstoppable, no matter how much lobbying Monsanto conducts in a desperate effort to keep consumers ignorant about what they’re eating.
Whole Foods, of course, has already announced mandatory GMO labeling on everything it sells by 2018. I believe Wal-Mart and other retailers are also considering a similar move, or they’ll lose market share to Whole Foods.
At the same time, major food manufacturers are realizing they must either get the GMOs out of their products or face a massive consumer backlash. As a result, there is currently a mad rush by food companies to get their products certified by the Non-GMO Project. Across the board, products that achieve Non-GMO Project Verified status experience an almost immediate30% increase in sales nationwide.
Do the math: companies that use Monsanto’s GM corn are punished and boycotted in the marketplace. Companies that use non-GMO corn experience huge increases in sales. In food company corporate boardrooms all across America, this is a no-brainer: dump GMOs if you want to survive.
The same is also true for hedge funds and mutual funds: the more they invest in Monsanto, the more they stand to lose from the global outrage against Monsanto, GMOs and GM corn in particular.
Plus, I also happen to believe there will come a day when many of the top Monsanto executives will be arrested and prosecuted for their role in carrying out crimes against humanity (not just from GMOs but also from glyphosate). When that day comes, Monsanto share prices will obviously fall through the floor. The company may, in fact, implode like a dot-com bubble, leaving investors holding worthless paper instead of valuable shares… a kind of poetic justice for all those who furthered the means of such a destructive entity in the first place.

Monsanto is at war with humanity and the planet, but humanity will achieve victory against this evil corporate force of death and destruction. It is already happening in the marketplace and across the minds and hearts of millions of activists in stand in solidarity against corporate evil.
So spread the word about not just avoiding GMOs but also avoiding owning Monsanto stock in any form. If you have money invested in a mutual fund or hedge fund that owns Monsanto, sell the fund! Don’t let anyone use your money to further the profits of the biotech industry. Invest your money in something that helps humanity, not harms it.

US Government Once Again Hiring Monsanto Employees

Following in the footsteps of other Monsanto bigwigs going through the government’s revolving door, the seed company has again supplied a staff member for a position of authority in one of the very agencies that are allegedly present to protect the public from unsafe farming practices.  The Iowa Department of Agriculture has hired Mike Naig to serve as the deputy secretary.
Agriculture Secretary Bill Northey announced he has hired former Monsanto lobbyist Mike Naig as deputy secretary.
Naig was manager of state and local government affairs for Monsanto, the nation’s largest seed-corn company and a farm-chemical giant.
Naig will start Sept. 4.
“Mike will be a tremendous asset to the department and I’m glad he agreed to join our team,” Northey said in a statement. “His background and experience make him a natural fit for the department.”
